The process of authenticating a document so that it can be documented by the legal system of a foreign nation with full legal effect is called legalization. The procedure seeks to provide judicial & civil authorities with a trustworthy means of verifying the legitimacy of the document issued overseas. Because different nations use different terminology when discussing document legality, & it could be confusing. Getting a document legalized, authenticated, or issued with an apostille often refers to the same process, depending on where you live in the world.

Why Is Legalization Not the Same as Apostille?

It is equivalent to a domestic notarized document on a global scale. Documents no longer require double verification by the receiving country and once by the country of origin with Apostille Convention. Any document bearing an apostille certification will be legally recognized that has approved the Apostille Convention. However, this is only possible if both the country of origin & destination are parties to the Apostille Treaty. In many countries, legalizing papers has been replaced by our Document Legalisation.

Additional legalization is necessary if the document is to be used in a nation that is not a signatory to the Apostille Convention, such as Canada. Usually, this entails obtaining legalization from the relevant embassy. Additionally, it is important to keep in mind that many Commonwealth nations will just certify documents with a notary's signature, eliminating the need for legalization or an apostille.

Is Notarization Required for Legalization of a Document?

The type of document you need to have legalized will determine whether you need to have it notarized beforehand. An apostille can be used to issue standard papers such as marriage, birth, and death certificates, other certifications from accredited authorities, and official government documents without requiring notarization or prior signatures. Before an apostille is obtained or the legalization process starts, business documents often need to be approved by a solicitor. It is frequently possible to bind a collection of documents that your business requires certified into a certified set.
